1. SCOPE OF APPLICATION
These Terms and Conditions of Subscription (hereinafter "Terms and Conditions") apply to the subscription
functionality
implemented on the website www.velo.com/ch (hereinafter "Website").
The Website is operated by British American Tobacco
Switzerland SA, Route de France 17, 2926 Boncourt (hereinafter "BAT" or "we" or "us").
We reserve the right to amend and modify these Terms and Conditions at any time. The Terms and Conditions
that are in
force at the moment of your subscription order are applicable. It is your responsibility to regularly check
these Terms
and Conditions.
BAT reserves the right to change the rules and functionality of the subscription program at any time.
In the event of any differences between the German, French and English versions of the Terms and Conditions,
the English version will take precedence.
2. GENERAL CONDITIONS OF ELIGIBILTY
Participation is reserved exclusively for to tobacco and/ or nicotine consumers over 18 years and who are
residents in
Switzerland and who have registered on www.velo.com/ch The
indicated delivery address must be in Switzerland.
Only the Credit Card will be accepted for the subscription on the Website.
Users who have set up a user account on www.velo.com/ch and have met
the requirements for eligibility (particularly regarding age verification) may participate in the
subscription program after reading and accepting these Terms and Conditions.
3. PRODUCTS
The Subscription program extends to all VELO products (hereinafter "Products") proposed on the VELO ABO
section on https://www.velo.com/ch/en/subscription#.
4. CONTRACT CONCLUSION
A binding order for subscription is only triggered once you have entered all the data required for the
subscription,
have selected one of the available models (Gold, Silver, Bronze), have selected your Products or combination
of
Products, have chosen the starting date for the subscription, have acknowledged these Terms and Conditions,
and have
checked out in the order process. When you send the order, this is treated as your offer to us to conclude a
contract.
You will receive a confirmation email with all details. Every month, the subscription fee will be
automatically charged
on your payment method (e.g. credit card) based on your chosen model, and the selected products will be
delivered to the
address stated in your subscription.
5. AVAILABILITY AND DELIVERY
Should Products ordered not be available, BAT may not complete your order entirely. BAT reserves the right to
either
cancel your order in such an event or to deliver just part of the ordered Products. BAT will notify you
accordingly.
Orders confirmed by BAT will be delivered to the address stated in your subscription. If you are not at the
address when
the order is delivered, the Products will be left, if possible, in your mailbox. In case of delivery failure
on the
specified date, you will receive an invitation to collect your parcel with indications on how to proceed.
BAT may freely
dispose of Products that have not been collected from the post office and have been returned thereto.
We will only deliver to addresses located in Switzerland.
Orders are generally delivered within 1-2 business days after the order is placed, if the order is placed
Monday to
Thursday. Orders placed on Friday morning will normally be delivered on Tuesday. Orders placed on Saturday
or Sunday
will normally be delivered on Wednesday.
Delivery charges, times, and schedules: Priority delivery fees in Switzerland are offered for subscription
program. BAT
do not offer any Express delivery. BAT may change the values specified above at any time.
Delivery schedules and delivery times are not guaranteed and may vary. You will not be compensated for
delivery delays.
There are no deliveries on Sundays or national and cantonal holidays. Any liability regarding delivery times
is
excluded.
6. PAYMENT
For subscription program, you may only make payment using Credit Card.
Credit card: Your account will be debited every month at the chosen date of your monthly subscription.
We use Secure Socket Layer (SSL) encryption and other certified encryption technologies and systems to ensure
that your
personal data are secure at the time of the transaction.
Please be aware that there may be additional costs and fees when paying with credit cards depending on the
credit card
agreement concluded between you and the credit card issuer. BAT is not to be held liable for application of
third
parties' terms and conditions.
BAT reserves the right to exclude you from future use of and access to the subscription program and to delete
your
subscription in the event of non-payments or lack of sufficient credit card cover.
You cannot use VELO+ points for paying the subscription. But you can use these points outside of the
subscription

7. MODIFICATION OF THE SUBSCRIPTION
The number of cans per subscription model cannot be modified. The number of cans for each subscription model
is fixed.
The Products selected in your subscription can be changed at any time – up to the date that your monthly
order is
automatically placed. If you modified your Products after that date, the modification would only apply to
the following
monthly order.
You can change the selected subscription model at any time – up to the date that your monthly order is
automatically
placed. If you modified your subscription model after that date, the modification would only apply to the
following
monthly order. If your modification results in a pricing adjustment, you will need to confirm the payment
method again
at checkout.
You can change the delivery date of your subscription at any time - up to the date that your monthly order is
automatically placed. In that case your change will only apply to the subsequent order.

You can pause a subscription for one month. For instance, if you pause your subscription on the 15th of

placed. In case that your cancellation takes place after the date that your monthly order is automatically
placed, the
cancellation is not valid for this specific monthly order and will only apply to the next order.

8. TERMS OF USE AND DATA PRIVACY
The access and use of the Website is governed by the Terms of Use. The Terms of Use are
incorporated by reference.

9. WARRANTY AND LIABILITY
Warranty, liability, presentation of the Products on the Website, transport damages, as well as theft of
Products are
governed by the Terms and Conditions of Sale. These provisions are incorporated into this
Terms and Conditions by
reference.

jurisdiction is the user's place of residence, which must be in Switzerland.
